1. Reservation Cancellations

1.1 Standard Cancellation Policy

Customers may cancel a reservation up to 24 hours prior to the scheduled pickup time to receive a full fare refund. Cancellations may be submitted through the official website, mobile website, mobile applications, or by emailing info@ridedesotocab.com.

For reservations made by telephone, the booking fee is non-refundable.

1.2 Late Cancellations and No-Showsl

DeSoto Cab Company LLC will not issue a refund for any reservation cancelled or modified less than 24 hours prior to the scheduled pickup time.
Reservations made within two hours of the scheduled pickup time are also non-refundable if cancelled or abandoned.

Failure to appear or failure to provide accurate contact information may be treated as reservation abandonment, resulting in forfeiture of the fare.

2. Flight Cancellations and Delays

If your flight is cancelled or delayed, you must notify DeSoto Cab Company LLC at least 24 hours before the scheduled pickup time.
Failure to provide timely notice may result in the reservation being marked as abandoned and the fare being forfeited.

3. Credit Card & Payment Policy

• A valid credit card is required to confirm your reservation.

• Your credit card will be charged before the service is provided.

• All payments are securely processed through Stripe, a PCI-compliant payment processor.

• We do not store or have access to your credit card details.

By providing your payment information, you authorize DeSoto Cab Company LLC to charge your card for:

• Fare and booking fees

• Late cancellation or no-show fees

• Tolls, additional services, or damages (if applicable)

All payments are collected on behalf of independent drivers. By submitting payment information, you confirm that you are the authorized cardholder.

4. Role of DeSoto Cab Company LLC

4.1 Intermediary Platform

DeSoto Cab Company LLC operates solely as a booking and payment platform. The company does not:

• Own or operate vehicles

• Employ drivers

• Provide transportation services directly

All rides are provided by independent third-party contractors, who are solely responsible for the safety, condition, and operation of their vehicles.

4.2 Limitation of Liability

By booking through this platform, you agree that DeSoto Cab Company LLC is not liable for any issues related to transportation services provided by independent contractors, including:

• Delays or late arrivals

• Service cancellations

• Accidents, incidents, or injuries

• Quality of service

• Loss of personal items

Any disputes or claims relating to transportation services must be directed to the contractor who provided the ride.

4.3 No Warranties

DeSoto Cab Company LLC makes no warranties, express or implied, regarding availability, pricing, or service quality. Use of the platform is at your sole risk.

5. Acceptance of Terms

By requesting a booking, you acknowledge and agree to:

2. The operational and service policies of the independent contractor providing your transportation.

DeSoto is not a taxicab company and does not employ taxicab drivers. DeSoto provides a platform that connects riders with independent, self-employed owner-operators who offer transportation services in their local area. All drivers operating through the DeSoto platform are independent contractors and are not employees, agents, or representatives of DeSoto. DeSoto does not control the manner or means by which drivers provide transportation services and is not responsible for the actions, omissions, vehicle condition, or compliance of any independent driver. Riders contract directly with the independent owner-operator who provides the transportation service.

• Weather

The Company may refuse service to any individual who poses a risk to safety or is acting unlawfully.

• Local city and county taxi ordinances

• Requirements related to vehicle safety, licensing, and insurance under municipal regulations

All drivers must maintain required local permits, insurance, and vehicle inspections.

4. Fares and Payment

4.2 Payment Methods

If the driver arrives and the rider does not appear within the standard wait time, a no-show fee will be charged.

• Avoid damaging the vehicle

• Follow driver safety instructions

DESOTO CAB COMPANY LLC may refuse or terminate service if a rider becomes unsafe or disruptive.

7. Driver Responsibilities

Drivers representing DESOTO CAB COMPANY LLC must:

• Follow all applicable local taxi and transportation regulations

• Maintain a clean and safe vehicle

• Treat riders with courtesy

• Drive responsibly and obey traffic laws

• Assist riders when appropriate and safe

8. Lost & Found

DESOTO CAB COMPANY LLC is not responsible for belongings left in vehicles.
Found items may be returned to riders at their expense. Items unclaimed after 30 days may be discarded.

9. Limitation of Liability

To the fullest extent permitted by law, DESOTO CAB COMPANY LLC is not liable for:

• Delays due to traffic, weather, or mechanical issues

• Injuries resulting from rider negligence or misconduct

• Lost or damaged personal items

• Indirect, consequential, or incidental damages

Any liability is limited to the cost of the specific ride.

10. Privacy Policy

We handle personal information in accordance with applicable California privacy laws, including the California Consumer Privacy Act (CCPA).
Information may be used for:

• Booking and dispatching rides

• Safety and security

• Payment processing

• Legal compliance

11. Refusal of Service

DESOTO CAB COMPANY LLC reserves the right to refuse service to anyone who:

• Creates a safety risk

• Appears intoxicated or aggressive

• Attempts to defraud the Company

Company Cancellation; No Liability; Exclusive Remedy

Right to Cancel.

DeSoto Cab reserves the absolute and unilateral right to cancel, modify, or reschedule any booking at any time, with or without prior notice, due to operational constraints, safety concerns, force majeure events, or any other reason deemed necessary in the Company’s sole discretion.

No Guarantee of Service.

All reservations are subject to availability and operational feasibility. The Company does not guarantee the availability, timeliness, or completion of any scheduled service.

Exclusive Remedy.

In the event of a cancellation by the Company, the customer’s sole and exclusive remedy, if any, shall be limited strictly to a refund of the amount actually paid for the canceled service. The Company may, at its sole discretion, elect to issue a credit instead of a refund.

No Responsibility for Alternative Transportation.

Under no circumstances shall the Company be responsible or liable for any costs, fees, or expenses incurred by the customer in securing substitute or alternative transportation, including but not limited to taxis, rideshare services, limousines, shuttles, or vehicle rentals, regardless of the reason for cancellation.

Disclaimer of Damages.

To the fullest extent permitted by California law, the Company shall not be liable for any damages of any kind, including but not limited to:

• indirect damages
• incidental damages
• consequential damages
• special or punitive damages

This includes, without limitation, missed flights, missed appointments, delays, loss of income, loss of business opportunities, or personal inconvenience, even if the Company has been advised of the possibility of such damages.

Limitation of Liability.

To the maximum extent permitted by law, the total cumulative liability of the Company for any claim arising out of or relating to the booking or services shall not exceed the total amount paid by the customer for the specific booking at issue.

Assumption of Risk.

By booking services, the customer acknowledges that transportation services are subject to variables outside the Company’s control and assumes all risks associated with delays, cancellations, or service interruptions.

Governing Law and Venue.

This Agreement shall be governed by the laws of the State of California. Any dispute shall be brought exclusively in the state or federal courts located within California, and the parties consent to such jurisdiction and venue.

Severability.

If any provision of this section is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

Acknowledgment.

By completing a reservation, the customer confirms that they have read, understood, and agreed to these terms.

Drivers providing transportation services through third-party providers are independent contractors and are not employees, agents, or representatives of DeSoto. Third-party transportation providers operate independently and are solely responsible for the transportation services they provide.

DeSoto may facilitate the dispatch and referral of transportation requests to third-party providers but does not control the specific manner in which those independent providers perform transportation services and is not responsible for the actions, omissions, vehicle condition, safety, or legal compliance of any third-party provider. Riders matched with a third-party provider contract directly with that provider for the transportation service.

DeSoto Cab Company LLC is a small, independently owned company and is not affiliated with DeSoto Cab Company, Inc., the former San Francisco taxi company now operating under the Flywheel name, or with any other similarly named transportation provider.
